These Terms of Use govern your access to and use of the services, platform, and content provided by Pyzareth ("we," "us," or "our") through pyzareth.com (the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. Acceptance of Terms
By registering an account, browsing the Platform, or engaging with any service offered by Pyzareth, you confirm that you have read, understood, and agree to these Terms of Use, as well as our Privacy Policy. These Terms form a legally binding agreement between you and Pyzareth.
If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Eligibility
You must be at least 16 years of age to use the Platform independently. Users under 16 may access the Platform only with verifiable consent and supervision of a parent or legal guardian. By using the Platform, you represent and warrant that you meet these eligibility requirements.
We reserve the right to verify eligibility at any time and to suspend accounts where eligibility requirements are not met.
3. Account Registration
3.1 Creating an Account
Certain features of the Platform require you to register an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated at all times.
3.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at support@pyzareth.com if you suspect any unauthorized access to or use of your account.
3.3 One Account Per User
Each user may maintain only one active account. Creating multiple accounts to circumvent restrictions or gain unauthorized access to services is prohibited.
4. Services Offered
Pyzareth provides an online educational platform focused on portrait drawing instruction. Services may include, but are not limited to:
- Group online learning sessions with live instructors
- Individual private lessons with personalized guidance
- Structured learning paths adapted to learner progress
- Access to educational materials, recorded content, and instructor feedback
- Community interaction features among learners
The availability, format, and scope of services may change at our discretion. We will make reasonable efforts to notify users of material changes in advance.
5. Payments and Billing
5.1 Fees
Access to certain services requires payment of fees as described on the Platform at the time of purchase. All fees are stated in the applicable currency and are inclusive of any applicable taxes unless otherwise noted.
5.2 Billing
By providing payment information, you authorize Pyzareth or its payment processors to charge you the applicable fees. Recurring subscriptions will be billed automatically at the start of each billing cycle unless cancelled prior to renewal.
5.3 Refunds
Refund eligibility depends on the specific service purchased and is described in the relevant service description at the time of purchase. We reserve the right to issue or decline refunds at our discretion in cases of misuse or violation of these Terms.
5.4 Failed Payments
If a payment fails, access to paid services may be suspended until the outstanding balance is resolved. We will attempt to notify you using the contact details associated with your account.
6. Acceptable Use
You agree to use the Platform only for lawful purposes and in a manner consistent with these Terms. The following actions are strictly prohibited:
- Reproducing, distributing, or publicly displaying any Platform content without prior written permission
- Uploading or transmitting harmful, offensive, defamatory, or unlawful content
- Attempting to gain unauthorized access to any part of the Platform or its infrastructure
- Interfering with or disrupting the integrity or performance of the Platform
- Using automated tools, bots, or scrapers to extract data from the Platform
- Impersonating any person or entity, or misrepresenting your affiliation with any person or entity
- Sharing your account credentials with third parties or reselling access to Platform services
- Engaging in harassment, abuse, or discriminatory conduct toward other users or instructors
Violation of acceptable use standards may result in immediate account suspension or termination without refund.
7. Intellectual Property
7.1 Platform Content
All content available on the Platform, including but not limited to course materials, video lessons, illustrations, written guides, instructor feedback, and platform design elements, is the exclusive property of Pyzareth or its licensors and is protected by applicable intellectual property laws.
7.2 License to Users
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use Platform content solely for your personal, non-commercial educational purposes. This license does not include the right to sublicense, sell, or distribute any content.
7.3 User-Submitted Content
By submitting artwork, assignments, comments, or other content to the Platform, you grant Pyzareth a worldwide, royalty-free, non-exclusive license to use, display, and distribute such content for the purposes of operating and promoting the Platform. You retain ownership of your submitted content and represent that you have the right to grant this license.
8. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We encourage you to review the Privacy Policy to understand how we collect, use, and protect your personal information. By using the Platform, you consent to our data practices as described therein.
9. Third-Party Services and Links
The Platform may contain links to or integrations with third-party websites or services. These are provided for convenience only. Pyzareth does not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party service. Your interactions with third-party services are solely between you and those parties.
10. Disclaimers
The Platform and all content and services provided through it are offered on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that:
- The Platform will be uninterrupted, error-free, or secure at all times
- Any specific educational outcomes or skill levels will be achieved
- Content will always be accurate, current, or complete
To the fullest extent permitted by applicable law, Pyzareth disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Pyzareth and its affiliates, officers, employees, instructors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claims arising out of or relating to these Terms or the Platform shall not exceed the total amount you paid to Pyzareth in the twelve (12) months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Pyzareth and its affiliates, officers, instructors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses — including reasonable legal fees — arising out of or in any way related to your use of the Platform, your violation of these Terms, or your infringement of any rights of another person or entity.
13. Termination
13.1 Termination by You
You may terminate your account at any time by contacting us at support@pyzareth.com. Termination does not entitle you to a refund for any unused portion of a paid subscription unless otherwise required by applicable law.
13.2 Termination by Us
We reserve the right to suspend or permanently terminate your account and access to the Platform at our sole discretion, with or without notice, if we determine that you have violated these Terms or engaged in conduct harmful to other users, instructors, or the Platform.
13.3 Effect of Termination
Upon termination, your license to use the Platform and its content ceases immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, and indemnification — shall continue to apply.
14. Modifications to Terms
We may update these Terms of Use from time to time. When we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where appropriate, by sending a notice to the email address associated with your account.
Your continued use of the Platform after the effective date of any updated Terms constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must discontinue use of the Platform.
15. Governing Principles
These Terms are intended to be interpreted in a fair and reasonable manner consistent with general principles of good faith and fair dealing. 16. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the validity and enforceability of the remaining provisions.
17. Entire Agreement
These Terms of Use, together with our Privacy Policy and any additional terms applicable to specific services you use, constitute the entire agreement between you and Pyzareth regarding your use of the Platform and supersede all prior agreements, representations, or understandings relating to the same subject matter.
